Terms and Conditions
These short Terms apply to everyone using the evooia app, whatever your role. They cover the basics needed to use the app. Once you sign in, the full terms that match your role apply in addition: Terms for Patients, or Terms for Clinics together with the Data Processing Addendum. evooia is provided by Mojo Innovation AG, Zurich, Switzerland ("Mojo", "we", "us"). If you do not agree to these Terms, please do not use the app.
What evooia is
evooia is a Swiss software solution for before-and-after documentation and communication. It does not provide medical advice, diagnosis or treatment, and does not replace professional judgement. Always consult a qualified professional about your care.
Your account
Use only your own individual account and keep your login details confidential. You are responsible for all activity under your account.
Acceptable use
Use the app only lawfully and as intended. You must not resell or sublicense the app, reverse engineer it, bypass its security controls, or use it in a way that disrupts, impairs or interferes with the service, or enables unauthorised access to data.
Your content
You keep the rights to the content you add — including images, data and messages.
Because before-and-after documentation and communication with your clinic or professional are core features of evooia, content you capture in the app may be shared by default with the clinic or professional connected to your account, where you have given the required consent.
You can stop sharing new images and content for the future in the app. Content that has already been shared may continue to be processed and retained where needed for care, documentation, compliance, security or legal record-keeping purposes.
The full rules on ownership, use, sharing, withdrawal of consent and retention of your content appear in your role-specific terms after sign-in.
Privacy
How we process personal data is explained in our Privacy Notice, which forms part of these Terms.
Photos can contain health-related data. Before the first photo is captured and, where applicable, shared with the clinic or professional connected to your account, we ask for your explicit consent in the app.
You can withdraw your consent or disable sharing of new images for the future as described in the app. This does not affect processing that has already taken place lawfully before withdrawal, or processing that we or your clinic must continue for legal, compliance, documentation or safety reasons.
Service and changes
The app is provided on an "as available" basis. We may update the app and these Terms from time to time. If a change is material, we will notify you in the app or by email.
Continued use of the app after the changes take effect means that you accept the updated Terms.
Liability
To the maximum extent permitted by law, the app is provided without warranty and on an "as is" basis. We are liable only for intent and gross negligence, and not for indirect or consequential damages.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory Swiss law. Detailed liability terms are set out in the role-specific terms.
Governing law and jurisdiction
These Terms are governed by Swiss law. The courts of Zurich, Switzerland, have exclusive jurisdiction, unless a mandatory legal venue applies.
